These Terms and Conditions (“Terms”) govern your use of the NorthCut Stump Grinding website and the stump grinding services provided by NorthCut Stump Grinding (“NorthCut,” “we,” “us,” or “our”), a locally owned business operating in the Twin Cities, Minnesota.

By using our website, requesting a quote, or engaging our services, you agree to be bound by these Terms. Please read them carefully. If you do not agree with any part of these Terms, you should not use our website or services.

1. Services Provided

NorthCut Stump Grinding provides professional stump grinding and related services to residential and commercial customers in the Twin Cities metro area of Minnesota. Services include, but are not limited to, residential stump grinding, commercial stump grinding, subcontract stump grinding, stump removal, and same-day stump grinding where available.

All services are performed at the sole discretion of NorthCut. We reserve the right to decline any job that we determine is unsafe, outside our service area, or otherwise outside the scope of services we provide.

2. Quotes and Pricing

Quotes are provided based on information and photos submitted by the customer. All quotes are subject to the following conditions.

Accuracy of information

Quotes are accurate when based on accurate information. If site conditions differ materially from what was described or shown in photos — including but not limited to stump size, access conditions, root spread, or proximity to utilities — we reserve the right to revise the quote before beginning work. Any revised quote will be communicated to the customer before work proceeds.

Flat pricing

When a quote is confirmed and site conditions match what was described, the quoted price is the final price. NorthCut does not charge additional fees after work is completed unless extra scope was discussed and agreed upon prior to or during the job.

Minimum charge

A minimum service charge of $175 applies to all jobs regardless of stump size or job duration. This minimum reflects the fixed costs associated with any service call, including travel, utility locates, equipment setup, and operator time.

Quote validity

Quotes are valid for 30 days from the date of issue. After 30 days, site conditions or operational costs may have changed and the quote may be subject to revision upon re-evaluation.

3. Scheduling and Cancellations

Scheduling

Jobs are scheduled after a quote is accepted by the customer. We make reasonable efforts to schedule jobs within the same week a quote is accepted, subject to availability, weather conditions, and the completion of required utility locates.

811 Utility locates

We call 811 to request underground utility locates before scheduling any job. Work will not begin until utility locates have been completed by the appropriate utility notification service. This is a legal requirement and a non-negotiable safety standard. Scheduling may be delayed if utility locate services experience unusual delays.

Customer cancellations

Customers may cancel a scheduled job at no charge provided cancellation is communicated to NorthCut at least 24 hours before the scheduled appointment. Cancellations made with less than 24 hours’ notice may be subject to a $50 cancellation fee to cover mobilization costs already incurred.

NorthCut cancellations

NorthCut reserves the right to cancel or reschedule a job due to weather conditions that make work unsafe, equipment issues, or other circumstances beyond our control. In such cases, we will notify the customer as promptly as possible and reschedule at no penalty to either party.

4. Customer Responsibilities

To ensure that work can be completed safely and efficiently, customers are responsible for the following.

  • Providing accurate information about the stump location, size, and site conditions when requesting a quote

  • Ensuring that the work area is accessible to our equipment at the time of the scheduled appointment

  • Disclosing any known underground utilities, irrigation systems, buried cables, or other subsurface features in the work area

  • Securing pets and informing household members that work will be performed on the scheduled date

  • Ensuring that any gate codes, keys, or access permissions needed to reach the stump are available on the day of the job

NorthCut will call 811 to have public utilities marked, but is not responsible for private utilities, irrigation lines, invisible fence wiring, or other subsurface systems that are not identified through the 811 locate process. Customers should notify us of any known private underground systems before work begins.

5. Limitation of Liability

Scope of liability

NorthCut Stump Grinding carries liability insurance for all work performed. In the event of damage caused directly by our negligence during the performance of services, NorthCut’s liability is limited to the cost of repairing or replacing the damaged item, not to exceed the total amount paid for the service.

Exclusions

NorthCut is not liable for damage to the following.

  • Underground utilities, irrigation systems, or buried infrastructure not disclosed by the customer and not identified through the 811 locate process

  • Pre-existing damage to property, structures, or landscaping

  • Surface depressions, root decomposition, or settling of lawn areas that may occur in the months following grinding, which are normal consequences of stump removal

  • Adjacent trees, shrubs, or landscaping features that the customer did not specifically disclose as requiring protection

Force majeure

NorthCut is not liable for delays, cancellations, or failure to perform services resulting from circumstances beyond our reasonable control, including severe weather, utility locate delays, equipment failure due to unforeseeable causes, or other force majeure events.

6. Wood Chips and Site Cleanup

Stump grinding produces wood chips as a byproduct. Unless otherwise agreed at the time of booking, wood chips will be left on-site in a neat pile. The customer may use these chips as fill, mulch, or compost material, or arrange for disposal through their local waste service.

If the customer requests that chips be hauled away by NorthCut, this service must be requested and confirmed at the time of booking. Additional charges may apply for chip removal. NorthCut is not responsible for disposing of chips left on-site after the completion of work if the customer later decides they do not want them.

7. Payment Terms

prior to the job. NorthCut accepts payment by the methods communicated at the time of invoicing.

For commercial clients, net-30 payment terms may be available by prior arrangement. Invoices not paid within the agreed terms may be subject to a late fee of 1.5% per month on the outstanding balance.

NorthCut reserves the right to pursue collection of unpaid invoices through available legal channels, including small claims court. The customer agrees to reimburse NorthCut for any reasonable costs incurred in collecting an unpaid balance, including filing fees.

8. Photography and Marketing

NorthCut may photograph work sites before and after job completion for internal records and marketing purposes, including use on our website, social media accounts, and other promotional materials. Photos used for marketing will not include identifying personal information such as street addresses, vehicle license plates, or recognizable personal property.

If you prefer that photos taken at your property not be used for marketing purposes, please notify us in writing before or at the time of service and we will honor that request.

9. Subcontractor Work

NorthCut Stump Grinding offers subcontract grinding services to tree service companies and other contractors. When performing subcontract work, NorthCut operates as an independent contractor and is not an employee or agent of the contracting company. NorthCut maintains its own insurance and is solely responsible for the manner in which services are performed.

Subcontract arrangements, including pricing, scope, and invoicing preferences, are governed by the terms agreed upon at the outset of the arrangement and these general Terms and Conditions.

10. Website Use

Our website is provided for informational purposes and to facilitate contact with NorthCut. You agree to use the website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the website.

NorthCut makes reasonable efforts to keep website content accurate and up to date. However, we do not warrant that all information on the website is current, complete, or error-free. Pricing, service offerings, and availability are subject to change without notice. Actual pricing will be confirmed in your individual quote.

NorthCut reserves the right to modify or discontinue any part of the website at any time without notice.

11. Intellectual Property

All content on the NorthCut Stump Grinding website, including text, photographs, graphics, logos, and service descriptions, is the property of NorthCut Stump Grinding and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use any website content for commercial purposes without our prior written consent.

12. Dispute Resolution

In the event of a dispute arising from our services or these Terms, we encourage you to contact us directly first. Most concerns can be resolved quickly and informally through direct communication.

If a dispute cannot be resolved informally, it shall be governed by the laws of the State of Minnesota. Any legal proceedings arising from these Terms or our services shall be brought in the appropriate courts of Ramsey County or Hennepin County, Minnesota, and both parties consent to the jurisdiction of those courts.

13. Changes to These Terms

NorthCut reserves the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to our website with an updated effective date. Your continued use of our website or services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
